Terms and Conditions

Coalville Public Radio ("CPR", "we", "us", "our") is operated by CPR CIC, a Community Interest Company limited by guarantee and registered in England and Wales (company number 17173702), incorporated on 22 April 2026, with an asset lock. CPR CIC took over the operation of Coalville Public Radio from the previous unincorporated association with effect from 1 May 2026. CPR holds an Ofcom Digital Sound Programme Service Licence (Licence number DP106122BA/1).

These Terms and Conditions govern your use of our website (coalvillepublicradio.com), our mobile app, our live stream and Listen Again services, and the competitions, advertising, sponsorship, and outside broadcast services we provide. By using our services, you agree to these terms.

Part A — Using Our Website, App, and Listening Services

1. Acceptable Use

You agree to use our website, app, live stream, and Listen Again service only for lawful purposes.

You must not attempt to disrupt, overload, or gain unauthorised access to any part of our services, systems, or content.

You must not use our services to transmit any material that is unlawful, harmful, defamatory, offensive, or infringes the rights of any third party.

We may restrict, suspend, or terminate access to our services at any time where we consider use to be in breach of these terms.

2. Content and Intellectual Property

All content on this website — including the CPR name, logo, mascot (TU Can the Toucan), "If TU Can, you can too!" slogan, audio, images, text, and programme artwork — is owned by or licensed to CPR CIC and protected by copyright and trade mark law.

You may listen to and share our content for personal, non-commercial use. You must not copy, reproduce, broadcast, edit, distribute, or commercially exploit our content without our prior written permission.

Programme recordings are retained for 42 days in accordance with our Ofcom licence obligations and may be made available via our Listen Again service during that period.

3. Listen Again and On-Demand Content

Our Listen Again service makes selected programmes available to listen to after broadcast. Availability of individual programmes is at our discretion and may change without notice.

Listen Again content is provided for personal listening only and must not be downloaded, copied, redistributed, or used commercially without our permission.

4. External Links and Third-Party Content

Our website and social media channels may contain links to third-party websites and content. We are not responsible for the content, accuracy, or practices of any third-party sites.

Sponsor and advertiser content is provided by the businesses concerned. Inclusion of a sponsor or advertiser does not constitute an endorsement by CPR.

5. App and Smart Speaker Access

Our mobile app is available via the Google Play Store. Availability and functionality may vary by device and platform.

You can also listen by asking your smart speaker to "play Coalville Public Radio." Smart speaker availability depends on the device and platform provider and is outside our control.

We do not charge you to listen via our website, app, or smart speaker. Standard data charges from your network provider may apply.

Part B — Giveaway Terms and Conditions

Coalville Public Radio loves giving back with amazing giveaways! You must be a UK resident aged 18 or over, winners are chosen fairly, and prizes are non-transferable. Full terms are available at coalvillepublicradio.com. Good luck!

1. Introduction and Eligibility

Coalville Public Radio (CPR) may run competitions, giveaways, or prize draws (collectively referred to as "Giveaways") from time to time. These Terms and Conditions govern participation in and administration of all Giveaways hosted by CPR.

1.1. Participants must be residents of the UK aged 18 or over, unless otherwise stated.

1.2. Employees, volunteers, and associates of CPR CIC and their immediate families, as well as those involved in the provision of prizes, are not eligible to enter.

1.3. CPR reserves the right to verify the eligibility of participants.

1.4. These Terms and Conditions are accessible on CPR's website and will be referenced in all Giveaway promotions.

2. How to Enter

2.1. Entry methods for each Giveaway will be detailed in the associated promotional materials.

2.2. No purchase is necessary.

2.3. CPR is not responsible for entries that are incomplete, lost, delayed, or not received due to technical errors or any other reason beyond its control.

2.4. Where entries incur costs (e.g., text or call charges), these costs will be clearly specified in the promotional materials.

3. Prizes

3.1. Prize details, including any restrictions, will be specified in the promotion of each Giveaway.

3.2. Prizes are non-transferable, non-exchangeable, and non-refundable. No cash alternative is available.

3.3. In the event that a prize becomes unavailable, CPR reserves the right to substitute it with another of equal or greater value.

3.4. CPR is not responsible for any third-party products or services offered as prizes. Any issues or disputes regarding prizes must be directed to the supplier.

3.5. CPR makes no guarantees about the availability or condition of prizes beyond the specifications provided in the promotional materials.

4. Winner Selection and Notification

4.1. Winners will be selected via the method specified in the Giveaway's promotional materials (e.g., random draw, judged entry).

4.2. Winners will be notified via the contact details provided upon entry. CPR will make reasonable attempts to contact winners, but if no response is received within 14 days, the prize may be forfeited and another winner selected.

4.3. CPR's decision in relation to the winner selection process is final.

4.4. Winners may be announced publicly on CPR's platforms, including their name and general location (e.g., city or town), unless the winner requests otherwise.

5. Liability and Cancellation

5.1. CPR reserves the right to amend, cancel, or suspend a Giveaway at any time without notice if circumstances arise that are beyond its reasonable control.

5.2. CPR is not responsible for any loss, damage, or disappointment caused by participating in or being unable to participate in a Giveaway, to the fullest extent permitted by law.

5.3. CPR does not accept any responsibility for any tax implications arising from a prize.

5.4. CPR shall not be held liable for any issues with a prize provided by a third party.

5.5. CPR shall not be held responsible for any delays, modifications, or cancellations due to events outside its control, including but not limited to natural disasters, acts of government, technical failures, or other force majeure events.

6. Disqualification

6.1. Participants who fail to comply with these Terms and Conditions or provide false information will be disqualified.

6.2. CPR reserves the right to disqualify any participant suspected of tampering with the entry process or acting in bad faith.

6.3. Participants must not engage in abusive, fraudulent, or offensive conduct towards CPR staff, volunteers, or other participants. CPR reserves the right to disqualify participants violating this clause.

7. Publicity and Privacy

7.1. By entering a Giveaway, participants agree that CPR may use their name, image, audio, video, and entry for promotional purposes without additional remuneration.

7.2. Personal data provided during the entry process will be processed in accordance with CPR's Privacy Policy.

7.3. Participants may opt out of promotional use of their personal data by notifying CPR in writing.

8. Intellectual Property

8.1. All intellectual property rights in and to the Giveaway and any promotional materials created by CPR shall remain the exclusive property of CPR CIC.

8.2. By entering a Giveaway, participants grant CPR a non-exclusive, royalty-free licence to use, reproduce, modify, publish, and distribute their entry (including name, image, and likeness) for promotional purposes.

8.3. Participants warrant that their entries do not infringe any third-party intellectual property rights. Any breach of this warranty will result in disqualification.

Part C — Advertising and Sponsorship Terms

1. Bookings and Agreements

1.1. All advertising and sponsorship bookings are subject to availability and confirmed only once CPR has issued a written confirmation and any agreed payment has been received.

1.2. Advertising and sponsorship rates are as published on our Advertising and Sponsorship page at the time of booking, unless otherwise agreed in writing.

1.3. Long-term bookings may attract discounted rates by agreement. Any discount applies only for the agreed booking period.

2. Advertiser Responsibilities

2.1. Advertisers and sponsors warrant that all advertising content supplied to CPR is accurate, lawful, and does not infringe the rights of any third party.

2.2. All advertising content must comply with the BCAP UK Code of Broadcast Advertising, the Ofcom Broadcasting Code, and all applicable UK advertising and consumer protection law. CPR reserves the right to refuse, edit, or withdraw any advertisement that does not comply.

2.3. CPR reserves the right to refuse any advertisement at its discretion, including content that is misleading, offensive, politically sensitive, or incompatible with CPR's community ethos.

3. Payment and Cancellation

3.1. Invoices are payable in accordance with the terms stated on the invoice. Late payment may result in suspension of advertising until the account is settled.

3.2. Cancellations must be made in writing. Cancellations made with less than 14 days' notice before the scheduled start of a campaign may be subject to a charge, at CPR's discretion.

3.3. CPR is not liable for failure to broadcast an advertisement due to circumstances beyond its control (e.g., technical failure, force majeure). Where practicable, affected advertising will be rescheduled.

4. DAB and Digital Advertising

4.1. DAB advertising will be available once CPR's DAB service is live to listeners. Until launch, DAB advertising is offered as a pre-launch booking and is subject to the DAB service commencing.

4.2. CPR does not guarantee specific audience figures or listening numbers for any advertising or sponsorship placement.

Part D — Outside Broadcast Bookings

1. Booking and Notice

1.1. CPR prefers at least 4 weeks' notice for outside broadcast bookings. We can accommodate shorter notice (subject to availability) where possible.

1.2. A booking is confirmed only once CPR has issued written confirmation and any agreed deposit or fee has been received.

1.3. Setup and breakdown typically take around 1 hour each and should be factored into event planning.

2. Event Organiser Responsibilities

2.1. The event organiser is responsible for providing safe, level space for the outside broadcast setup, access to power (where agreed), and any site-specific requirements communicated in advance.

2.2. Where events require public liability or event-specific insurance proof, the organiser is responsible for supplying documentation in advance.

2.3. The organiser warrants that the event is lawful and that all necessary permissions, licences, and consents for the event have been obtained.

3. Cancellation and Liability

3.1. Cancellations by the organiser must be made in writing. Cancellations made with less than 14 days' notice may be subject to a charge to cover committed costs, at CPR's discretion.

3.2. CPR reserves the right to cancel or curtail an outside broadcast due to circumstances beyond its control, including adverse weather, safety concerns, or force majeure. Where practicable, CPR will offer an alternative date.

3.3. CPR carries public liability insurance for its volunteers during outside broadcasts. CPR is not responsible for any loss, damage, or injury arising from the event itself, which remains the responsibility of the event organiser.

Part E — General

1. Governing Law

1.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

1.2. By using our services or entering any Giveaway, you agree to be bound by these Terms and Conditions.

1.3. Any dispute will first be attempted to be resolved through good faith negotiation. If a dispute cannot be resolved through negotiation, it shall be subject to alternative dispute resolution (such as mediation) before resorting to the courts of England and Wales.

2. Changes to These Terms

2.1. CPR may update these Terms and Conditions at any time. The current version and date are shown at the top of this page.

2.2. Continued use of our services after a change constitutes acceptance of the updated terms.
